Recently, the Town has received calls requesting information about motorized bicycles and scooters. This is due in part because of false or misleading information given by local retailers.  The following are some basic guidelines, which may help answer your questions:

Motorized Bicycles are defined by State Law as “a vehicle having two or three wheels, a cylinder capacity not exceeding 50 C. C., and an automatic transmission which produces a maximum design speed of not more than thirty miles per hour on a flat surface”. These vehicles are not required to have a license plate or insurance.   A common misconception regarding the Motorized Bicycle is that anybody can drive these on a public street.  Although it is true that you do not need a motorcycle license to operate them, you must have in your possession a valid drivers license. When operating at night, the vehicle must be equipped with a working headlight and rear reflector, or red taillight and an operating horn.

Motor-driven cycle’s are defined by State Law as “every motorcycle, including every motorscooter, with a motor which produces not to exceed six brake-horsepower and every bicycle with a motor attached, but not trail bikes, minibikes, go-carts, golf carts, and similar vehicles which are not designed for or approved by the department for use on the public roads or highways and not motorized bicycles as defined earlier”.

These vehicles are illegal on all roadways and sidewalks.  Note:  In Columbine Valley, this also includes all electric scooters and bicycles. Golf carts have been authorized by  ordinance in Columbine Valley allowing them on local roadways only.  S. Platte Canyon Rd. is a state highway and golf carts are not allowed.

Keep in mind, these laws pertain to public roadways only and do not prohibit their operation on private property and private roadways.

Note:    Each jurisdiction has the authority to pass their own laws regarding these vehicles and you must check with your local law enforcement agency regarding what is legal in your jurisdiction
